READ CAREFULLY BEFORE SIGNING — THIS IS A RELEASE OF LIABILITY

1. DESCRIPTION OF ACTIVITY. Participant desires to engage in ninja warrior training activities at Pinnacle Athletics ("Pinnacle"), including but not limited to: traversing obstacle courses, climbing structures, jumping, swinging, use of training equipment, participation in classes and open gym sessions, and any related activities.

2. ASSUMPTION OF RISKS. Participant acknowledges that ninja warrior training involves inherent risks that cannot be eliminated without changing the essential nature of the activity. These risks include but are not limited to: falls from height onto padded or unpadded surfaces; collisions with obstacles, equipment, walls, or other participants; overexertion, muscle strain, and physical exhaustion; cuts, abrasions, bruises, and lacerations; fractures, dislocations, and joint injuries; sprains, strains, and soft tissue injuries; head, neck, and spinal injuries; and injuries caused by equipment failure or by the negligence of Pinnacle staff or other participants. Participant KNOWINGLY AND VOLUNTARILY ASSUMES ALL SUCH RISKS, both known and unknown.

3. RELEASE OF LIABILITY. In consideration of being permitted to participate, Participant, on behalf of themselves, their heirs, personal representatives, and assigns, hereby RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE Pinnacle Athletics, its owners, operators, employees, coaches, agents, and contractors ("Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may occur as a result of participation in Pinnacle's activities, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES or otherwise.

4. INDEMNIFICATION. Participant agrees to INDEMNIFY AND HOLD HARMLESS the Released Parties from any loss, liability, damage, or cost they may incur due to the presence of Participant at the facility or participation in activities, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES or otherwise.

5. FACILITY RULES. Participant agrees to follow all facility rules, safety guidelines, and instructions provided by Pinnacle staff at all times. Failure to comply may result in removal from the facility without refund.

6. MEDICAL AUTHORIZATION. Participant consents to emergency medical treatment in the event of injury or illness when Participant is unable to provide consent. Participant authorizes Pinnacle staff to contact emergency services as appropriate. Participant accepts sole financial responsibility for all associated medical costs.

7. GOVERNING LAW. This Agreement shall be governed by and construed in accordance with the laws of the State of Oklahoma. Any dispute arising under this Agreement shall be subject to the exclusive jurisdiction of the courts located in Oklahoma County, Oklahoma.

8. SEVERABILITY. If any provision of this Agreement is determined to be unenforceable, the remaining provisions shall remain in full force and effect.
